Job Description
ASSISTANT CITY ATTORNEY    

Pay Grade: 31                FLSA Status:    Exempt

Classification Summary:
The primary function of an employee in this class is to provide advanced legal services ranging from general legal advice and counsel to City management and employees on major departmental issues and projects to assisting decision makers with legal implications of decisions; code development or revision; negotiating, drafting, and reviewing contracts and development agreements to meet the needs and projects of various departments; represent the City in court, before boards, commissions, and administrative bodies in connection with claims or actions filed by or against the City. Work may also include prosecutorial duties when directed by the City Attorney

Essential Functions:
Essential Functions are not intended to be an exhaustive list of all responsibilities, duties and skills. They are intended to be accurate summaries of what the job classification involves and what is required to perform it. Employees are responsible for all other duties as assigned.
May concentrate duties in a specialized area for the Law Department such as civil litigation, City Code amendments; Transportation and Development contracts, forms, procedures and disputes; encroachment permits and the use of the City's rights of way and easements; property acquisitions; land use; public housing; Police Department issues; employment/labor law; environmental issues; water and wastewater; franchises; and City departmental contracts, forms and disputes;
Attends various meetings, including City Council meetings, boards, commissions, and committees and provides advice and legal interpretation;
Researches legal precedents, recently decided case law, federal laws, state statutes, state and federal regulations and City ordinances;
Prepares, reviews, and negotiates contracts, intergovernmental agreements, development agreements, memorandum of understanding, resolutions, leases, motions, ordinances, regulations and related documents;
Provides legal advice regarding personnel policies, discipline, complaints, claims and other personnel matters; reviews or drafts responses or position statements regarding EEOC claims asserted against the City; reviews, revises, drafts and approves employment/personnel policies or forms as required; reviews and provides legal advice on employee organization negotiations and contracts;
Enforces City policies in regard to land use, water issues, nuisances, jurisdictional issues and other City interests;
Negotiates and represents the City during discussions with third parties and regulatory agencies on a wide variety of agreements, settlements, rules and enforcement actions taken by or against the City including water rights and environmental litigation;
Negotiates and drafts agreements regarding domestic water delivery, water transportation, reclaimed water sale and exchange, use of wells, and related issues;
Negotiates license agreements with telecommunications and cable companies;
Represents City in acquisition of property through negotiated purchase or condemnation proceedings;
Advises and/or trains Police command staff and officers in areas such as civil liability and personnel matters and employment law, property issues, contracts, laws of arrest, search and seizure, civil conflict and records requests;
Revises Police general orders;
Pursues civil actions for the enforcement of forfeiture laws, public nuisance laws, and anti-gang laws;
Litigates issues involving property in police custody;
Provides advice on public records laws and open meeting laws;
Responds to citizen inquiries and complaints regarding legal matters; reviews and supervises the investigation of the complaints; and recommends resolutions to complaints;
May pursue bankruptcy claims and represent the City's interest in court;
May prosecute criminal cases before the municipal court and appeals from the municipal court to superior court and other courts of records as directed;

Civil Litigation Duties:
Defends the City, its officers and employees in civil litigation by complying with local, state, and federal laws;
Investigates charges by reviewing case information, interviewing witnesses, conducting legal research, preparing disclosure statements, gathering facts, applying case law, and recommending relevant courses of action;
Represents the City in civil litigation in State and Federal court in areas of tort and risk related claims; reviews documents, drafts correspondence, prepares discovery documents, prepares and files pleadings and substantive and procedural motions, discovery and trial exhibits and filings; coordinates and/or drafts responses to inquiries or legal pleadings, prepares briefs, engages in settlement and meditation discussions, recommends appropriate settlements and minimizes all legal and risk exposures; tries cases until dismissed, settled or determined by court or jury;
Prevents risk by working with employees, advising staff of legal issues, providing settlement input, supervising internal investigations, and advising elected officials on issues and/or pending litigation;
Appears in court trying cases, selecting juries, arguing motions, and performing other related duties;
Represents the City in hearings before the City's Merit Board, the EEOC, and other administrative agencies;

Other Duties and Responsibilities:
Performs all work duties and activities in accordance with City policies and procedures;
Works in a safe manner and reports unsafe activity and conditions. Follows City-wide safety policy and practices and adheres to responsibilities concerning safety prevention, reporting and monitoring as outlined in the City's Safety Handbook.
Some positions are on call 24 hours, seven days a week.

Knowledge, Skills and Abilities:
Knowledge of:
General municipal, state and federal laws affecting city government;
State of Arizona criminal and civil statutes, rules, administrative orders, policies and procedures, and applicable Federal rules and regulations;
Arizona judicial procedures and rules of evidence;
City ordinances, particularly those relating to the authority and functions of City departments;
Legal precedents and court decisions impacting municipal government;
Specialized legal areas of emphasis, such as civil litigation, environmental law, public utility law, Indian law, land use, rural property and conveyance, Police operations and POST certification, telecommunications and cable service providers, public rights of way, eminent domain, water rights, employment and labor law and other specialties;
State and federal court rules and trial techniques and procedures;
Established precedents and sources of legal references applicable to City activities;
English grammar and punctuation.

Ability to:
Analyze, appraise, and organize facts, evidence, and precedents in determining the various aspects and alternatives of cases and ability to present such material in a clear and logical form;
Write legal motions, appeals, special actions, and advisory memorandums;
Present material to opponents and develop an appropriate defense;
Make significant/substantial legal decisions in individual cases based on a combination of factors including the law, court rules, policy and rules of ethics;
Negotiate complex legal issues including contracts with third parties and produce complex documents and contracts;
Discern critical issues and needs of the City through a negotiations process;
Communicate effectively, both orally and in writing, for purposes of advocating, persuading, negotiating, and counseling for or on behalf of the City;
Develop alternative courses of action, and possible courses of action of opponents;
Present and defend the City's position in litigation;
Establish and maintain effective working relationships with other City employees, supervisory personnel, attorneys, law enforcement agencies, state and local elected officials, and the public;
Operate a personal computer and related software and demonstrate proficiency to prepare documents, spreadsheets, databases, email and timesheets;
Demonstrate integrity, ingenuity, and inventiveness in the performance of assigned tasks;
Use logical and creative thought processes to develop solutions according to written specifications and/or oral instructions.

The work is performed under the supervision of the City Attorney.

Minimum Qualifications:
Graduation from a School of Law accredited by the American Bar Association with a Juris Doctorate Degree;
License to practice law in the State of Arizona in the United States District Court for the State of Arizona and the United States Circuit Court of Appeals; and
Eight (8) years' experience in the practice of law, including some experience in municipal law or related area with an expertise in specialty areas of the practice of law as determined by the City Attorney; and
Membership in good standing in the Arizona State Bar Association or
Any equivalent combination of experience and training which provides the knowledge and abilities necessary to perform the work.

*Civil Litigation Specialty Only:
Graduation from a School of Law accredited by the American Bar Association with a Juris Doctorate Degree;
License to practice law in the State of Arizona in the United States District Court for the State of Arizona and the United States Circuit Court of Appeals; and
Eight (8) years' experience in the practice of law, including five (5) years' experience in civil litigation; and
Experience working with jury and non-jury trials; and
Membership in good standing in the Arizona State Bar Association or
Any equivalent combination of experience and training which provides the knowledge and abilities necessary to perform the work.

Work Environment:
The primary duties of this class are performed in a general office setting, in court and in regulatory agencies.

Sufficient clarity of speech and hearing or other communication capabilities, with or without reasonable accommodation, which permits the employee to discern verbal instructions and to communicate effectively in person, on a telephone, and in a courtroom environment;
